FDA must be allowed to regulate tobacco products, says American Cancer Society
Washington 1999/04/27 -The U.S. Supreme Court decision to hear whether or not the Food and Drug Administration should have full regulatory authority over the contents of tobacco products is a critical step in the right direction, says the American Cancer Society's CEO John R. Seffrin, PhD. As part of its support for this position, ACS will file a "friend of the court" brief.

"The American Cancer Society has long maintained that the Food and Drug Administration should have jurisdiction over tobacco products. Tobacco products contain nicotine, which we know is addictive," said Seffrin. "We hope the high court will affirm the original lower court decision to allow FDA authority."

The FDA is authorized by Congress to control both drugs and their delivery systems. The American Cancer Society will contend in its amicus brief to the Court both of these conditions have been met by the tobacco companies, and thus, the FDA should regulate tobacco.
